WHEN TO USE MEDIATION?

Mediation can save money and time, and is a good process to use when relationships matter.

Litigation and arbitration are adversarial processes where each party seeks to persuade the decision-maker (judge or arbitrator) that they are right and the other party is wrong. Adversarial processes can be particularly effective when future relationships are not a consideration and all of the parties have lots of money and time to fight.

Mediation is not an adversarial process, can be done at any time during a disagreement or dispute, and can result in a less-expensive and faster resolution.

Mediation that leads to agreement often also results in the parties having a better relationship than they started the process with. If you have a relationship that you would like to salvage, maintain or improve, then mediation might be for you.
